By registering an account, connecting an application programming interface (API) key, or accessing any service provided by Saglam Degersel, you confirm that you are at least 18 years of age (or the age of legal majority in your jurisdiction), possess the capacity to enter into binding agreements, and unconditionally accept these Terms. If you do not consent to these Terms, you must cease using the Platform immediately.
2. Nature of the Service
Saglam Degersel provides algorithmic execution software and automated market analytical tooling designed to interface with third-party digital asset trading venues. You explicitly acknowledge and agree that:
- Saglam Degersel is a non-custodial financial technology platform and not a bank, broker-dealer, custodian, asset manager, or registered financial investment advisor under the regulatory framework of the United Kingdom or any other jurisdiction.
- We do not take custody of, control, or hold your private keys, funds, or digital assets. All transactions executed via automated bots are conducted directly on your connected third-party exchange account.
- Nothing provided on the Platform constitutes professional financial, tax, or legal advice. All trade triggers, algorithmic calculations, and statistical projections are autonomous computational outputs produced according to user-configured rules.
3. Account Registration and Security
To use our automated execution capabilities, you may be required to register an account and generate platform credentials. You represent that all information supplied is truthful, current, and complete. You are solely responsible for safeguarding the confidentiality of your login credentials, two-factor authentication tokens, and API secret keys. Any activity performed under your account shall be considered authorized by you. In the event of unauthorized access, you must notify Saglam Degersel immediately at [email protected].
4. User Covenants and Prohibited Activities
While accessing or utilizing Saglam Degersel, you covenant that you will not:
- Deploy algorithmic configurations intended to manipulate markets, execute wash trades, or spoof order books on connected exchanges.
- Reverse-engineer, decompile, disassemble, or derive the source code of our trading engine and execution models.
- Bypass geographic restrictions, rate limits, or network security protocols through automated proxies or unauthorized scrapers.
- Utilize the Platform if you are located in, or a national of, a sanctioned territory or jurisdiction where crypto-asset trading is prohibited by law.
5. Service Availability and Execution Latency
While Saglam Degersel aims for high reliability, we do not warrant uninterrupted or fault-free uptime. Execution speeds and automated signals are subject to external factors beyond our control, including internet latency, network congestion, exchange API downtime, market slippage, and blockchain block confirmations. Saglam Degersel shall not be held liable for delayed executions, missed trades, or system halts caused by third-party infrastructure.
6. Intellectual Property Rights
All software architectures, algorithms, visual interfaces, documentation, logos, trademarks, and technical documentation are the sole proprietary property of Saglam Degersel and its licensors, protected by United Kingdom copyright laws and international intellectual property conventions. Users receive a limited, revocable, non-exclusive, non-transferable licence solely to access and utilize the Platform for lawful trading activities in compliance with these Terms.
7. Limitation of Liability and Disclaimer of Warranties
To the maximum extent permitted under applicable law, the Platform and all associated features are delivered “as is” and “as available” without warranties of any kind, whether express, statutory, or implied. Saglam Degersel disclaims all implied warranties of merchantability, fitness for a specific purpose, and non-infringement.
Under no circumstances shall Saglam Degersel, its directors, officers, or contractors be liable for direct, indirect, incidental, consequential, or punitive damages, including loss of profits, capital depreciation, loss of data, or operational disruption resulting from your trading activities, market volatility, or exchange outages.
8. Governing Law and Dispute Resolution
These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to settle any disputes, claims, or controversies arising under or relating to these Terms.
9. Modifications to Terms
We reserve the right to amend, update, or replace these Terms at our discretion. Any revisions will take effect immediately upon publication on this page with an updated revision date. Continued utilization of our software constitutes acceptance of the amended terms.
